Agency Agreement

 

  1. General provisions
    1. This Agency Agreement (hereinafter referred to as the "Agreement") governs the terms of interaction between the owner of the BuyFUN.net website (hereinafter referred to as the "Agent") and persons posting information about digital goods for their sale (hereinafter referred to as the "Seller").
    2. The BuyFUN.net website is an information resource designed to post information about digital products and attract potential buyers.
    3. The Agent provides services for the placement and promotion of information about the Seller's products under the terms of this Agreement.
    4. The Agent is not the seller of the goods, their manufacturer, copyright holder or buyer and does not become a party to the contracts concluded between the Seller and the Buyers.
  2. Hand
    1. SELLER
      1. A seller may be any individual or legal entity that has the necessary legal capacity and legal rights to sell digital goods, and is registered in the DigiSeller system or uses other legal technical means to sell and transfer digital goods to buyers.
      2. The seller independently determines the terms of sale of goods, including price, payment methods, and the procedure for providing the goods to the buyer.
      3. The seller acts on his own behalf and in his own interests.
    2. AGENT (BuyFUN.net)
      1. The Agent provides the Seller with agency services for information placement and promotion of goods.
      2. The agent is not the seller of the goods, their manufacturer, copyright holder or buyer.
      3. The Agent does not become a party to the contracts concluded between the Seller and the Buyers.
  3. Posting information about products
    1. Information about the product is posted on the BuyFUN.net website based on information provided by the Seller.
    2. The Agent does not participate in the formation of the content of the digital product and does not have and cannot have the technical or actual ability to access its content, files, keys, accounts, subscriptions, or other elements of the product.
    3. The agent places information about a product without conducting a special examination of its content and legal status.
  4. Seller's warranties and obligations
    1. By posting information about a product, the Seller confirms that:
      • has all the necessary rights and powers to distribute and sell the product;
      • the product complies with the requirements of the legislation of the Russian Federation, the countries of the Commonwealth of Independent States and the countries of the European Union;
      • the product does not violate the rights of third parties, including copyright and related rights;
      • the sale of goods is carried out for legal purposes.
    2. The seller is solely responsible for the accuracy of the information provided and the legality of the goods offered.
  5. Prohibited goods
    1. The BuyFUN.net website does not allow the placement of goods specified in “List of prohibited goods”.
    2. The seller undertakes to familiarize himself with the specified List and comply with its requirements when placing goods.
  6. Settlements with buyers and agency fees
    1. All settlements between the Seller and the Buyer are carried out by the Seller independently and directly, without the participation of the Agent.
    2. The Agent does not participate in payment processing, does not process payment information, and is not involved in refunds or financial disputes.
    3. If the buyer was attracted through the BuyFUN.net website, the Seller pays the Agent an agency fee.
    4. The amount and procedure for payment of the agency fee are determined by the conditions established by the Seller and the Agent.
  7. Responsibility of the parties
    1. Each Party shall be responsible for the fulfillment of its obligations in accordance with this Agreement and applicable law.
    2. The seller independently regulates relations with buyers and third parties related to the sale of goods.
  8. Final provisions
    1. This Agreement shall enter into force upon its acceptance by the Seller and shall remain valid for the entire period of use of the BuyFUN.net services.
    2. Use of the BuyFUN.net website signifies the Seller's agreement with the terms of this Agreement.
